• Introduction

Protecting your private information is our priority. This Privacy Policy governs data collection and usage of the Learning Management System (“LMS”) provided by ME Academy.  By accessing or using the LMS, you consent to the data practices described in this policy and in our Terms of Service. If you do not agree to any part of this Privacy Policy, then you must desist from accessing the Services. 

• Definitions

2.1. API: Application Programming Interface are a set of protocols, tools, and definitions for building software and applications. They include related documentation, source code, SDKs (Software Development Kits), executable applications, and other materials provided by the API partner.

2.2. Cookies: Small text files placed on your device by a website, which store information about your preferences and actions.

2.3. LMS: This Learning Management System platform provided by ME Academy for the delivery of online courses, training programmes, and educational content focused on the practice of corporate commercial law.

2.4. Geolocation Data: Information about your physical location, typically collected from your IP address or GPS-enabled devices.

2.5. Personal Data: Any information relating to an identifiable person, which may include but is not limited to: name, email, identification numbers, IP address, geolocation, etc. It is information that can be used alone or with other data to identify, contact, or locate an individual.

2.6. Processing of Personal Data: Any operation or set of operations performed on personal data, such as collection, storage, modification, sharing, analysis, or deletion.

2.7. Service: Products and services provided by ME Academy on the Learning Management System such as online courses, training programmes and educational content focused on the practice of corporate commercial law.

2.8. Third Party: Any entity or individual outside of ME Academy who may have access to personal data for specific purposes, such as analytics, marketing, customer service, billing for Services, or legal compliance. 

2.9.  Tracking Technologies: Tools such as pixels, cookies and other tracking mechanisms used to collect and analyse user behaviour and interaction with the LMS platform, often for marketing and improvement of services. 

2.10. User: Any individual or entity that accesses, registers for, or otherwise uses the LMS, including legal professionals, lawyers, trainees, and law firms.

•   Collection of your Personal Data

ME Academy may collect personally identifiable information, such as, but not limited to, name, physical address, telephone number and IP address. The information that we collect and store often depends on the type of Service that you use. For example, when you subscribe to a course, we collect and maintain your account information such as login name, password, email address and contact information. 

If you contact our customer service team, we may retain relevant communication records, such as emails, phone calls, or chat transcripts, for purposes of improving service quality and resolving any issues you raise. If your access to the LMS is sponsored by your employer or another organisation, we may collect and store information about your affiliation with the sponsoring entity for account management and reporting purposes. ME Academy will retain user information in compliance with applicable legal and operational requirements, but we will honour requests to delete personal data submitted by account holders, as outlined in this Privacy Policy.

Information about your computer hardware and software may be automatically collected by ME Academy. This information can include: your IP address, browser type, domain names, access times, operating system, cookie information, referring website addresses, and Internet Service Provider. ME Academy also collects geolocation information based on visitors’ IP addresses. This information is used by ME Academy for the operation of the service, to maintain quality of the service, and to provide general statistics regarding use of the Services. In order to better understand how users use its site and to improve its services, ME Academy may also collect information about your use of our Site, such as pages visited, links clicked, text entered, and mouse movements.

Please keep in mind that if you directly disclose personally identifiable information or personally sensitive data about your use of the LMS to third parties, this information may be collected and used by them. ME Academy encourages you to review the privacy statements of entities or services you access from our LMS so that you can understand how those entities collect, use and share your information. ME Academy is not responsible for the privacy statements, privacy practices, or content on websites or services outside of those we operate.

3.2.  Use of your Personal Data

ME Academy collects and uses your personal information to operate and improve our Services and deliver the Services you have requested. ME Academy may also use your personal information to inform you of other products or services available from ME Academy and its affiliates that may interest you.  We may also contact you to participate in surveys to conduct research   about your opinion of current services or of potential new services that may be offered.

ME Academy does not sell, rent or lease its customer lists to third parties. We may, from time to time, contact you on behalf of external business partners about a particular offering that may be of interest to you. In cases where you request us to do so, we will share your personal information with trusted business partners so that they can offer you products or services that you’ve expressed interest in. In those cases, your unique personally identifiable information (e-mail, name, telephone number) shall not be transferred to the third party without your express consent.

ME Academy may share data with vendors or processors to help us perform statistical analysis, send you email or postal mail, perform tasks required to complete a purchase transaction, provide customer support, or provide other types of customer relationship management. We may also share information on your use of our Site, such as the pages visited, links clicked, non-sensitive text entered, and mouse movements, with third party providers of web and application analytic services in order to enable ME Academy to understand site usage, detect fraud and any potential threats as well as improve its Services. All such third parties are prohibited from using your personal information except to provide the services, and they are obligated to maintain the confidentiality of your information, although in some cases, those third parties are allowed to use aggregated and disidentified data for the improvement of their own services.

Additionally, if you access our LMS through a third party, and in the course of doing so you provide information to them, the third party may retain and use the information you provide pursuant to their privacy policy. In such cases, the third party’s use of your personal information is governed by their privacy policy and not ME Academy’s privacy policy.

ME Academy may disclose personal information when we believe it is required to comply with the law (such as, a lawful subpoena, warrant or court order); to enforce or apply this Privacy Policy or our other policies or agreements; to initiate, render, bill, and collect for amounts owed to us; to protect our or our users’ rights, property or safety; to protect our users from fraudulent, abusive, or unlawful use of the Services; or if we believe that an emergency involving the danger of death or serious physical injury to any person requires or justifies disclosure of personal information.

In certain situations, ME Academy provides an API licence to business partners in order for them to provide certain services to ME Academy via their own websites or applications. In these situations, we may collect, store, and disclose to the relevant API partner your personal data to enable the API partner to offer our Services and/or its services to you, or for purposes of sending you marketing communications as permitted under applicable law. We also collect, store and use personal information gathered via the API business relationship for purposes of monitoring and improving our Services.

4. Use of Cookies

Our website uses “cookies” to help personalise your online experience. Cookies are uniquely assigned to you, and can only be read by a web server in the domain that issued the cookie to you.

One of the primary purposes of cookies is to allow you to be logged in to your account. If you register an account with ME Academy, a cookie helps us recall your specific information on subsequent visits. This simplifies the process of recalling your personal information, such as your billing address. When you return to our website, the information you previously provided can be retrieved, so you can easily use the features of our Service.

We use third parties such as Google Analytics for data collection and analysis to collect, process and store your site usage and browser information on our behalf when you use our Services.

ME Academy uses tracking technologies to create remarketing audiences of Users based on user behaviour and visits to our website. ME Academy may also target these users with custom ads based on affinities/interests, geographic and demographic signals. Furthermore, ME Academy may use email addresses to target users with custom ads through third party advertising platforms. ME Academy shares certain customer information described in Section 1 above with third parties to perform services (advertising) on our behalf.

5. Grounds for Collection and Processing of Personal Data

ME Academy processes your Personal Data based on the following grounds:

1. Your Consent: Where you have explicitly agreed to the collection and use of your data for specific purposes, such as marketing or promotional activities.
2. Contractual Necessity: To perform a contract to which you are a party, or to take steps at your request prior to entering into a contract.
3. Legitimate Interests: To improve our services, prevent fraud, and ensure the security of our platform, provided such interests do not override your rights.
4. Legal Obligations: To comply with applicable laws, including but not limited to anti-money laundering, taxation, and regulatory compliance.
5. Vital Interests: To protect your vital interests or those of another person in cases of emergency.
6. Public Interest: For the performance of tasks carried out in the public interest, particularly those aligned with educational or professional development goals.

ME Academy processes your Personal Data with your consent, to fulfil or enter into contracts, improve our Services, prevent fraud, comply with legal obligations,  protect vital interests in case of emergencies, and when required for public interest.

6. Transfer of Personal Data

In the event of any arrangement whereby ME Academy sells or transfers all, or a portion of, its business or assets (including in the event of a reorganisation, dissolution or liquidation) to third parties, you hereby consent that your Personal Data held with ME Academy through your use of the LMS can be transferred or assigned to third parties who may become the controllers and/or processors of your Personal Data that was held by ME Academy prior to such arrangement. ME Academy shall at all times ensure that you are notified when your Personal Data is intended to be transferred to third parties in the circumstances outlined in this paragraph.

You consent to the transfer of your Personal Data to a recipient in a foreign country or to an international organisation located outside of Nigeria, if we comply with the Nigerian Data Protection Act 2023, Nigeria Data Protection Regulation 2019 (as may be amended, extended, re-enacted or consolidated from time to time – the “NDPR”) and other applicable laws.

9. Handling Data Breaches

In the event of a data breach:

1. affected users will be promptly notified of the breach and provided details on its nature and scope.
2. ME Academy will take immediate action to secure systems and mitigate potential harm.
3. A report will be filed with relevant regulatory authorities in compliance with the Nigerian Data Protection Regulation (NDPR).

ME Academy will not be responsible for any personal data breach which occurs as a result of:

1. an event which is beyond the control of ME Academy;
2. an act or threats of terrorism;
3. an act of God (such as, but not limited to fires, explosions, earthquakes, drought, tidal waves and floods) which compromises our data protection measures;
4. any hostilities (whether war be declared or not), invasion, act of foreign enemies, mobilisation, requisition, or embargo;
5. rebellion, revolution, insurrection, or military or usurped power, or civil war which compromises our data protection measures;
6. the transfer of your personal data to a third party on your instructions; and
7. the use of your personal data by a third party designated by you.

We will take immediate steps to secure our systems and minimize any potential harm while reporting the incident to the relevant authorities. However, ME Academy will not be liable for breaches caused by events beyond our control, such as natural disasters, acts of terrorism, war, civil unrest, or instructions given by you to transfer data to third parties. If you suspect a data breach, please contact us immediately. 

10. Violation of this Policy 

Any person subject to this Policy who is found to be in breach of this Policy by:

1. failure to implement safeguards required by the NDPR or any of the security measures provided in this Policy;
2. failure to mitigate the damage once it has occurred; or
3. failure to timely notify the affected individuals;
4. may be liable, in addition to any other civil liabilities, to the penalties provided in the NDPR.

11. Children Under Eighteen

Our Services are not intended for use by persons under the age of 18 (eighteen) years, and such use is prohibited by our Terms of Service.
